Watch the second episode of the documentary looking into the Michael Stone case. The model used here to examine the case is a model we think should be used in all miscarriage cases. An independent panel examine all the case papers and materials in this case. It’s a stark contrast to what happens here in Scotland with access to case papers and material being withheld from campaigners and their supporters with access only being allowed through a solicitor. The problem with this approach is that many of those making claims of innocence may have had appeals refused and so have no active appeal and no solicitor representing them. They can only develop a further appeal with access to all the papers related to their case. So access to justice is being restricted. This approach is justified by the crown in the name of finality. However where there are innocent men and women craving justice there will never be finality, and neither should there be.
